Acceptance of Terms
By accessing or using the Pivot platform, website, or any related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.
Your agreement is indicated by checking the acceptance checkbox at account registration. We record the date, time, and version of these Terms you agreed to. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
Section 02
Eligibility
To use the Service you must:
- Be at least 18 years of age
- Be a resident of the United States
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the Service under applicable law
We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
Section 03
Your Account
To access the Service, you must create an account by providing a valid email address and uploading a resume in PDF format. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account security. You are responsible for all activity that occurs under your account. Pivot uses passwordless authentication via single-use email links. You agree to notify us immediately at support@joinpivot.co if you become aware of any unauthorized use of your account.
One account per person. You may not create multiple accounts or share your account with others. Accounts are personal and non-transferable.
Account data. You may request deletion of your account and all associated data at any time from your account settings or by emailing us. Upon deletion, your resume, matches, saved jobs, and personal information will be permanently removed within 30 days.
Section 04
The Service
Pivot is an AI-powered job matching platform. The Service scrapes publicly available job postings from company career pages and applicant tracking systems, matches them against your uploaded resume using machine learning algorithms, and delivers a curated digest of matched roles to your inbox on a twice-weekly schedule (Monday and Thursday).
What Pivot is not. Pivot is not a staffing agency, recruiter, or employment agency. We do not guarantee job placement, interviews, or employment outcomes. We do not represent employers or act on their behalf. Job listings are sourced from public career pages and may be expired, filled, or inaccurate by the time you receive your digest.
No guarantee of accuracy. While we make reasonable efforts to ensure job listings are current and accurate, we make no representations or warranties regarding the completeness, accuracy, reliability, or timeliness of any job listing, salary estimate, match score, or AI-generated insight provided through the Service.
Service availability. We strive to maintain reliable service but do not guarantee uninterrupted availability. The Service may be modified, suspended, or discontinued at any time with or without notice.
Section 05
Subscriptions & Billing
Pivot offers three service tiers:
- Basic (Free Trial) — 2 digest emails delivered over 1 week at no cost. A valid payment method is required at signup to activate your trial. At the end of the 1-week trial, your account automatically converts to the paid tier you selected at signup (Plus or Pro) and your card will be charged. You may cancel at any time before the end of the trial to avoid being charged.
- Plus ($12/month) — Unlimited digest emails, salary ranges, match scores, and unlimited saved jobs.
- Pro ($20/month) — Everything in Plus, plus AI match insights, company watchlist alerts, and access to Market Intelligence.
Trial conversion. By signing up, you authorize Pivot AI Corp to charge your selected payment method at the end of the 1-week free trial for the tier you selected, and to continue charging on a recurring monthly basis until you cancel.
Auto-renewal. Paid subscriptions (Plus and Pro) automatically renew at the end of each billing cycle unless you cancel before the renewal date. By subscribing, you authorize Pivot AI Corp to charge your payment method on a recurring monthly basis.
Upgrades and downgrades. You may upgrade your subscription at any time; the upgrade takes effect immediately and is charged on a prorated basis for the remainder of the current billing cycle. Downgrades take effect at the start of the next billing cycle; you retain access to your current tier's features until then.
Price changes. We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price increase via email. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
Failed payments. If a payment fails, we may suspend your access to paid features. We will attempt to notify you via email. It is your responsibility to maintain a valid payment method on file.
Taxes. Prices are exclusive of applicable taxes. You are responsible for any sales, use, or similar taxes applicable to your subscription.
Section 06
No Refunds
Cancellation. You may cancel your subscription at any time from your account settings. Cancellation stops future charges. Upon cancellation, you retain access to paid features through the end of the current billing period. No partial refunds are issued for unused days in a billing cycle.
Free trial. The Basic free trial includes 2 digest emails delivered over 1 week at no charge. A valid payment method is required at signup. If you cancel before the trial ends, you will not be charged. The free trial is provided as-is and is not eligible for any compensation or credit.
Exceptions. Pivot AI Corp may, at its sole discretion and as a goodwill gesture, issue credits or refunds in exceptional circumstances. Any such issuance does not create an obligation to do so in the future.
Section 07
Your Content
You retain full ownership of any content you upload to the Service, including your resume and personal information ("Your Content").
License to Pivot. By uploading Your Content, you grant Pivot AI Corp a limited, non-exclusive, royalty-free license to use, store, process, and analyze Your Content solely for the purpose of providing the Service to you. This license is revoked upon account deletion.
Your representations. You represent and warrant that: (a) you own or have the right to upload Your Content; (b) Your Content does not violate any third-party rights; and (c) Your Content is accurate and relates to your own professional experience.
No sale of your data. Pivot AI Corp does not sell, rent, or trade your resume or personal information to third parties for marketing purposes. See our Privacy Policy for full details on how your data is used.
Section 08
AI & Data Processing Disclosure
Pivot uses artificial intelligence and machine learning to power its core matching and insight features. By using the Service, you acknowledge and agree to the following:
- Resume processing. Your uploaded resume text is processed by third-party AI services, including Anthropic's Claude API, to generate a structured professional profile, match scores, and AI-generated match insights. Resume content sent to third-party AI providers is subject to their respective terms of service and privacy policies.
- Match scores are algorithmic. Match percentages and rankings are generated by automated algorithms and do not constitute professional career advice or a guarantee of suitability for any role.
- AI insights are not guarantees. "Why you stand out" and "To close the gap" insights are AI-generated assessments based on your resume text and publicly available job description data. They may be incomplete, inaccurate, or not representative of how a specific employer evaluates candidates.
- Salary estimates. Salary ranges shown in the Service are derived from scraped job posting data, publicly available compensation data, and algorithmic estimation. They are provided for informational purposes only and do not represent guaranteed or negotiated compensation.
- No human review. Job matching, scoring, and insight generation are fully automated. No human at Pivot AI Corp reviews individual matches before delivery.
Section 09
Acceptable Use
You agree not to use the Service to:
- Upload false, misleading, or fabricated resume content
- Create multiple accounts or impersonate another person
- Attempt to access, scrape, or extract data from the Service through automated means
- Reverse engineer, decompile, or otherwise attempt to derive source code from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service for any unlawful purpose or in violation of any applicable law
- Resell, sublicense, or commercialize access to the Service or its outputs
- Upload any content that contains malware, viruses, or other harmful code
Violation of this section may result in immediate account termination without notice or refund.
Section 10
Intellectual Property
The Service, including its design, software, algorithms, text, graphics, and all other content created by Pivot AI Corp, is owned by Pivot AI Corp and protected by US and international copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any right to use Pivot's name, logo, trademarks, or branding without prior written consent from Pivot AI Corp.
Job listings surfaced through the Service are sourced from public career pages and remain the property of the respective employers. Pivot claims no ownership over third-party job content.
Section 11
Disclaimers
Pivot AI Corp expressly disclaims all liability for:
- The accuracy, completeness, or timeliness of any job listing
- The accuracy of any match score, salary estimate, or AI-generated insight
- Any employment decision made by you or any employer based on the Service
- Any failure to match you with a job listing that may have been relevant
- Actions or omissions of third-party services integrated into the platform
Section 12
Limitation of Liability
Aggregate cap. In no event shall Pivot AI Corp's total cumulative liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total amount you paid to Pivot AI Corp in the twelve (12) months preceding the claim; or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages. In such jurisdictions, the above limitations apply to the maximum extent permitted by law.
Section 13
Indemnification
You agree to indemnify, defend, and hold harmless Pivot AI Corp and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Any content you submit, upload, or transmit through the Service
- Your violation of any applicable law or regulation
Section 14
Arbitration & Dispute Resolution
Agreement to arbitrate. Except for disputes relating to Pivot AI Corp's intellectual property rights or claims that qualify for small claims court, you and Pivot AI Corp agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Service — including the validity, enforceability, or scope of this arbitration provision — shall be resolved by final, binding arbitration administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures.
Individual arbitration only. All arbitration proceedings shall be conducted on an individual basis. You waive your right to participate as a plaintiff or class member in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Arbitration process. Arbitration shall be conducted in English. Unless you and Pivot AI Corp agree otherwise, arbitration will take place in Delaware or, at your election, via video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Costs. JAMS filing fees will be allocated in accordance with JAMS rules. If Pivot AI Corp initiates arbitration, we will pay all JAMS filing and administrative fees. If you initiate arbitration for a claim of $10,000 or less and the arbitrator rules in your favor, Pivot AI Corp will reimburse your reasonable JAMS filing fees.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@joinpivot.co with the subject line "Arbitration Opt-Out" and your full name and email address. Opting out does not affect any other provision of these Terms.
Governing law. These Terms and any disputes are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. To the extent court proceedings are permitted hereunder, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
Informal resolution first. Before initiating arbitration, you agree to first attempt to resolve the dispute informally by contacting us at legal@joinpivot.co. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within 30 days, either party may proceed to arbitration.
Time limit. Any claim arising under these Terms must be brought within one (1) year of the date on which the claim arose, or it is permanently barred.
Section 15
Termination
Termination by you. You may terminate your account at any time from your account settings or by emailing support@joinpivot.co. Termination stops future billing charges. No refund is issued for the current billing period.
Termination by Pivot. Pivot AI Corp reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to if we believe you have violated these Terms. Upon termination for cause, no refund will be issued.
Effect of termination. Upon termination: (a) your right to use the Service immediately ceases; (b) we will permanently delete your account and all associated personal data (including your resume, match history, saved jobs, watchlist, and account profile) within 30 days; (c) anonymized billing records will be retained for 7 years as required by US tax and accounting law; and (d) provisions of these Terms that by their nature should survive termination will survive, including Sections 7, 10, 11, 12, 13, 14, and 16.
Section 16
Changes to These Terms
Pivot AI Corp reserves the right to update or modify these Terms at any time. We will notify you of material changes by:
- Sending an email to the address associated with your account
- Displaying a prominent notice within the Service
- Updating the "Effective Date" at the top of this page
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may cancel your account.
For material changes that affect the arbitration agreement or your legal rights, we will provide at least 30 days' advance notice and an opportunity to opt out.
